Form 8843 With No Income: What F-1 Students Need to Know
Learn why an F-1 student may need Form 8843 even with no U.S. income, when to attach it, and where to check filing instructions.
You can have no U.S. wages and still have a federal tax form to file. Form 8843 explains why certain days in the United States are excluded from the substantial presence test. It is separate from the question of whether you owe income tax.
Who uses Form 8843?
An F-1 student who qualifies as an “exempt individual” for the substantial presence test generally completes Form 8843 for each applicable year. The label is confusing: the exclusion concerns days of presence, not a blanket income tax exemption. J-1 visitors and certain other individuals can also have Form 8843 obligations under different rules.
Your prior U.S. visits, visa category, and calendar years of presence affect the analysis. The IRS explains that qualifying students must submit a fully completed Form 8843.
File it with a return or by itself
If you are filing Form 1040-NR, attach Form 8843 as directed in the current instructions. If you are not required to file an income tax return, Form 8843 can be sent on its own to the IRS address stated in that tax year’s form instructions. Check the current-year form for the deadline and mailing address rather than relying on an old article.
Do not treat a campus payroll form, school registration, or immigration record as a substitute for Form 8843. Keep a completed copy and, if mailed, evidence of mailing.
Common mistakes to avoid
Count calendar years, not just full years of study. A short arrival late in December may still be one calendar year for this purpose. Make sure your visa and presence history are accurate, especially if you previously visited on another F, J, M, or Q status.
Form 8843 does not request a refund. If you had taxable income or want to recover overwithheld income tax, review whether Form 1040-NR is also needed.
What to do next
Check your tax residency, complete Form 8843 if you excluded student days, and use the tax year’s IRS instructions for filing details.
