Indian F-1 Students and Article 21(2): The Standard Deduction Rule
When an eligible Indian student filing Form 1040-NR may claim the standard deduction under the U.S.–India treaty.
Most nonresidents filing Form 1040-NR cannot take the standard deduction. The U.S.–India income tax treaty contains a specific exception for eligible students and business apprentices under Article 21(2). It can matter materially, but it is not an automatic benefit for every Indian citizen.
Check treaty eligibility
The IRS says a student or business apprentice eligible for Article 21(2) may claim the standard deduction, provided they do not claim itemized deductions. Review the treaty’s requirements for residence immediately before visiting, the purpose of the visit, and the income involved. Citizenship alone does not establish treaty residence.
Confirm federal nonresident status and prepare the return for the correct tax year. The deduction amount and calculation rules can change by year, so use that year’s Form 1040-NR instructions and Publication 519 worksheet rather than a number copied from a blog.
Report it on the right form
Publication 519 directs eligible Indian students and apprentices to the standard deduction calculation. Form 1040-NR instructions explain where to enter it and how filing status can affect the amount. Schedule OI may require treaty information; answer it consistently with the claim.
Keep proof of prior residence, student status, dates in the United States, and treaty eligibility. Review W-2 and 1042-S amounts so wage and treaty items are not counted twice.
Do not blend it with other claims
A standard deduction and itemized deductions are alternative ways to reduce taxable income; the IRS says an eligible claimant cannot take both. State tax returns may treat treaty provisions differently. Check the state’s rules separately.
What to do next
An eligible Article 21(2) claimant can have a valuable 1040-NR deduction. Verify every treaty condition and the year-specific calculation.
