Student Tax Treaties: Review Payroll Records Before 2027
Check your student tax-treaty records before the new payroll year. Review the treaty article, income category, prior claims, and employer documentation.

A student tax treaty payroll review is a useful fall task if your employer has applied a treaty benefit or asked for new documentation. Start with the precise treaty provision and your income category. Citizenship, a student visa, or a friend’s payroll result is not enough to establish your own eligibility.
Identify the benefit being claimed
The IRS explains that treaty relief can reduce withholding for qualifying income and requires appropriate documentation to the payer. Students claiming a qualifying exemption on personal-service compensation can use Form 8233 with the required statement. Different income categories can require different documentation.
Write the country, article, income type, and claimed period on one worksheet. Keep the treaty text or official reference beside it. If you cannot identify the actual provision, ask the payroll office or a qualified adviser to explain it before signing a new certification.
Review prior claims and changes
Put previous claim forms and year-end statements in date order. Note a new employer, a new type of income, or a change in the underlying facts. Ask the payroll office what it needs for the next year and what its processing deadline is. An employer’s paperwork deadline is an administrative deadline, so record it separately from a tax-return due date.
- Keep copies of signed payer forms.
- Record which employer received each document.
- Save questions about time limits or dollar limits for review.
Reconcile payroll with filing records
Compare any treaty-related W-2 and 1042-S amounts with your pay history when the forms arrive. Keep a note explaining how the benefit was applied. If records do not reconcile, ask the payer about the difference before treating the forms as separate additional payments or omitting one.
Frequently asked question
Should every student submit Form 8233? No. It is used for qualifying treaty claims on specified personal-service income. The appropriate form and eligibility depend on the actual payment and treaty.
What to do next
Ask payroll now which documents it needs for a 2027 review, and retain a copy of the explanation.
