F-1 FICA Refund: When to Use Forms 843 and 8316
See the employer-first process for recovering Social Security and Medicare taxes withheld in error from qualifying F-1 work.
If Social Security or Medicare tax was taken from your pay, first check whether that tax was actually due. Qualifying authorized work by certain nonresident F-1 students can be exempt from these taxes. The exemption can end when federal tax residency changes.
Check eligibility before asking for a refund
Verify your tax residency for the year, your F-1 status, and whether the employment was authorized and connected to the purpose of your visit. The IRS notes that authorized CPT and OPT work can qualify for the nonresident student FICA exemption. A resident alien for tax purposes generally does not qualify for that visa-based exemption.
Look at W-2 boxes 4 and 6 and compare them with pay statements. Only claim amounts actually withheld in error. Federal income tax in box 2 is a separate matter handled through an income tax return.
Contact the employer first
Ask payroll to review the withholding and refund the tax if it was taken in error. Give them the documents needed to verify your status and work authorization. The IRS instructs students to seek a refund from the employer before filing a claim with the IRS.
If the employer will not provide a full refund, obtain a statement showing any reimbursement or explaining its refusal. Keep correspondence and payroll records.
The IRS claim route
The IRS says Form 843 may be used when the employer cannot provide the full refund. Supporting material can include the W-2, passport visa page, I-94, employer statement, and, when applicable, Form 8316. Follow the current IRS list and filing address carefully; incomplete claims can be delayed.
For many employees, Social Security and Medicare withholding together equal 7.65% of covered wages, though wage limits and special circumstances can change the amount. Form 843 is the refund request; Form 8316 helps explain why your employer did not reimburse you. Use the forms and instructions for the tax year of the erroneous withholding, and claim only the amount you can document.
What to do next
Confirm the exemption, ask payroll to correct the error, then use the IRS claim process if necessary.
